On the ongoing German court case between PreussenElektra and Vattenfall

On the ongoing German court case between PreussenElektra and Vattenfall regarding the transfer of residual amounts of electricity from the nuclear power plant Krümmel.

PreussenElektra has sued Vattenfall for free transfer of 44 terawatt hours of residual amounts of electricity from the Krümmel nuclear power plant. Vattenfall is basically prepared to transfer these residual amounts of electricity, but only against payment of a reasonable sales price. This complies with the requirements of the German Atomic Energy Act, which demands operators to market their residual amounts of electricity at reasonable conditions.

Vattenfall and PreussenElektra have now agreed to settle the injunction proceedings and, upon PreussenElektra’s request, to transfer 10 terawatt hours residual amounts of electricity from the nuclear power plant Krümmel to the nuclear power plant Grohnde.

The purchase price is to be paid back should by non-appealable ruling in the ongoing main proceedings PreussenElektra’s view be confirmed that at least 10 TWh had to be transferred for free. 

The application for an injunction has been withdrawn by PreussenElektra.

In the main proceedings, the first instance, the Regional Court of Hamburg will decide on 29.08.2019.
